Where Bitfinex stands with U.S. customers
Bitfinex does not serve U.S. individuals and has not since 2017. On August 11, 2017 it announced it would stop verifying U.S. individuals immediately, stop letting them trade ERC-20 tokens, and discontinue all services to existing U.S. retail customers over the following 90 days, citing a verification backlog, difficulty providing dollar deposits and withdrawals for Americans, and the U.S. regulatory environment. Its terms of service have barred U.S. persons from opening accounts ever since.
New York is barred twice over. The February 2021 settlement with the New York attorney general required Bitfinex and Tether to stop all trading activity with any New York person or entity, in addition to the $18.5 million payment. Bitfinex holds no FinCEN registration and no state money transmitter licenses, and there is no U.S. affiliate; some large U.S. institutions have reportedly kept access under separate arrangements, which does nothing for a retail buyer.

What "available" leaves out
Availability is not the same as presence. Bitfinex has no U.S. office you can visit, no U.S. phone line, and no cash rail. None of that stops a purchase going through, but it matters the moment an American customer needs an American answer: a bank that blocked the card, a wire that needs to go out today, a cash payment from a business that runs on cash.
