The checklist: does Kraken pass?
Kraken is one of the most established names in crypto. It opened in 2011, has never suffered a major breach of its exchange systems, and was the first large exchange to publish proof-of-reserves attestations, which it now does regularly, most recently as of December 31, 2025. It is registered with FinCEN, licensed as a money transmitter in most states, and its parent Payward filed confidentially for a U.S. IPO in November 2025. The SEC's case against it was dismissed in March 2025.
Its reputation with regulators is more complicated than its reputation with security researchers. Kraken paid $30 million in 2023 to settle the SEC's claims over its U.S. staking product, and it has chosen not to serve New York rather than seek a BitLicense. None of that is a reason to doubt that your money is safe on Kraken. It is a reason to know that Kraken is custodial, that account holds are common in its reviews, and that the only escalation path is a chat window. How to protect yourself on any platform
